This is a developing area of the law and much of the legal advice will arise from new case law coming out of the courts in North America.</span></div>

Uber Tech., Inc No. CGC-14-536979 (Calif.Super.Ct.San Fransisco Cnty. filed Jan 27, 2014 - a confidential settlement was reached in 2015. Because of the case, Uber changed its policies to provide insurance coverage for crashes its drivers caused while logged into the app, even when no passenger was in the vehicle).</span></div>

(see Maynard v. McGee & SnapChat, Inc. No. 16-SV-89 (Ga. Spalding Cnty. filed April 19, 2015). </span></div>

<span style="font-family: "arial" , "helvetica" , sans-serif;">This is a fascinating and ground breaking award for injury victims in BC. Cost of Future Care is an award designed to deal with future medical expenses post settlement or trial judgement. Philosophically, your lawyer should be advocating for compensation that is medically recommended and reasonable. In the Wilhelmson case, this young injury victim could no no longer bare children and could reasonably be expected to incur future costs associated with paying a surrogate to have a biological child. </span><br />
<span style="font-family: "arial" , "helvetica" , sans-serif;"><br /></span>
<span style="font-family: "arial" , "helvetica" , sans-serif;">The Court discussed this award starting at paragraph 366 and stated as follows:</span><br />

<a href="https://www.blogger.com/null" name="_Toc479755224"><i>Is She Entitled to Damages for Surrogacy Fees?</i></a></h2>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[366]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>As stated above, I find that the best and safest way for Ms. Wilhelmson to have a biological child would be to use the services of a surrogate. Both parties agree that the loss of Ms. Wilhelmson’s ability to carry her own child is compensable. The plaintiff submits that the damages for cost of future care should include costs for a gestational carrier (a “surrogate”), as the accident has left her fertile but unable to carry her own child to term. The defendant submits that the plaintiff’s inability to have a child, together with the recent termination of a pregnancy, should be compensated only under the award for non-pecuniary damages.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[367]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>I find the medical evidence overwhelmingly support the conclusion that a surrogate is medically necessary for Ms. Wilhelmson to have a biological child. That is clearly compensable. Ms. Wilhelmson got pregnant before the accident and there was no indication whatsoever that she could have carried that child to term. She cannot safely do so now. She is entitled to be put in the same position she was had the accident not happened. Surrogacy fees are the only way to do that. I did not understand the defendant to suggest otherwise. Instead, the defendant focussed on whether a specific award for surrogacy fees was precluded for other reasons.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[368]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>The plaintiff submits that there is legal precedent for covering private clinic costs and U.S. health care expenses, and that the surrogacy fees she is claiming fall under into those categories: Engqvist v. Doyle, 2011 BCSC 1585 and Morgan Estate v. Newfoundland, 2007 NLCA 40.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[369]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>In Engqvist, the plaintiff who suffered soft tissue damage from two motor vehicle accidents, made a claim for money to pay for private health care due to the specific treatment she required and the accelerated healing that private care would facilitate. In his decision, Rogers J. states that “[t]he first point to address on this issue is that it does not concern the Canada Health Act. … Instead, the fundamental question is whether a particular treatment modality is reasonably necessary to promote the plaintiff’s mental and physical health…”. Essentially, he considered any public policy concerns about private versus public health care to be irrelevant. The test the plaintiff had to meet was whether the care would be sufficiently necessary and beneficial to her. The judge found it was and damages were awarded.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[370]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>In Morgan, a plaintiff who had been injured in a car accident in Canada had since moved to the United States. She sought an award for medical treatment available in the US that was unavailable in Canada. She also sought special damages to reflect the increased cost of health care in the U.S. Cameron J.A. affirms the trial judge’s decision to take judicial notice of the fact that the U.S. has a private health care system and that may increase the plaintiff’s future care costs. The plaintiff was given an increased damages award to reflect that.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 6pt; text-indent: 0in;">
<i>[371]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>The defendant says that a specific award for surrogacy fees is not available as such an award would be contrary to public policy. To support this argument he points to s. 6 of the Assisted Human Reproduction Act, S.C. 2004, c. 2 (the AHR Act) which makes it illegal to pay a woman to be a surrogate in Canada.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 6pt; text-indent: 0in;">
<i>[372]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>The defendant also relies on 57134 Manitoba Ltd. v. Palmer, [1989] B.C.W.L.D. 1543 (CA). In that case the Court of Appeal upholds the trial court’s finding that the plaintiff could not be compensated for the loss of a discount due to the fact that the discount was contrary to s. 34 of the Combines Investigation Act. The trial judge stated that “[t]he court will not lend itself to assist the plaintiff in taking advantage of another's illegal act” (at para. 38).</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 6pt; text-indent: 0in;">
<i>[373]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>The facts of Palmer are very different from this case, but the defendant submits that the rationale is applicable. He submits making an award for surrogacy fees would be contrary to the AHR Act, just as making an award based on the discount would be have been contrary to the Combines Investigation Act.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[374]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>I do not agree. In Palmer, the court concluded its award would sanction illegal conduct. In this case there is no such danger; Ms. Wilhelmson is not seeking surrogacy fees to pay a surrogate in Canada, which would contravene the AHR Act. Instead, she is seeking fees which would allow her to embark on the lawful activity of compensating an American surrogate. The AHR Act cannot apply outside Canada’s borders. Dr. Yuzpe testified he was aware of Canadians successfully hiring American surrogates with no known legal complications. I have been presented with no evidence or case law which convinces me that this practice contravenes Canadian law in any way.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[375]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Based on the evidence in this case, a specific award for surrogacy fees is more appropriate than assuming her loss is adequately compensated for within the award for non-pecuniary damages. While the lost ability to carry a child to term certainly has caused Ms. Wilhelmson pain and suffering, deserving of recognition within the non-pecuniary damages, the fact that she is unable to carry a child leads to a distinct future cost to allow her to have a biological child -- the cost of hiring a surrogate. I find this cost is medically necessary and reasonable. Its necessity arose directly from the accident; therefore the cost must be borne by the defendant.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[376]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>I find some support for my view in Sadlowski v. Yeung, 2008 BCSC 456. In that case the plaintiff underwent a hysterectomy and she alleged the defendant, a gynaecologist, failed to adequately inform her of her medical condition and treatment options. The operation left the plaintiff infertile, and she alleges had she been adequately informed she would not have proceeded with the hysterectomy.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 6pt; text-indent: 0in;">
<i>[377]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>The court awarded her $90,000 for the loss of fertility as a separate award from the $100,000 damages awarded for pain and suffering. In doing so, the court relied on Semeniuk v. Cox, [2000] A.J. No. 51 at 78 where the judge noted the “invidious task” facing a judge trying to quantify the loss of fertility. In Semeniuk Acton J. also stated (para. 35):</i></div>
<div class="SCJQuote" style="font-family: Arial, sans-serif; font-size: 11pt; margin: 0in 0.5in 0.25in;">
<i>I am of the view on this point, however, that infertility is a type of loss not properly lumped together with the usual non-pecuniary categories of pain, suffering and loss of amenities. I find that an award at the low end of this range is appropriate and award $100,000 for surrogacy fees for two pregnancies.</i></div>

rehab clinics have discovered that ICBC often rejects continued rehab and/or
delays the approval process. Patients can
be left waiting even if they want to work towards getting better faster. Delays
can cause patients more stress and more pain. Some clinics offer their patients
the option to set up a running account that will be collected upon settlement -
these agreements are often called “Directions to Pay”. You need to review the fine print because quite
often, there is an interest component whereby you pay extra for the option to
pay later. It’s best to seek legal advice from an experienced lawyer before
entering into a Direction to Pay Agreement. If done properly, this can be an
excellent way to continue your rehab without the need for ICBC approval or
paying out of pocket for each treatment.

<b><span style="font-size: large;"><u>Long Answer:</u> It depends on what you are talking about, so I will break the discussion into a few categories. The real question is whether you are seeking compensation for someone else's negligence:</span></b></div>

<b><span style="font-size: large;">1) If you caused a motor vehicle accident, and are considered to be 100% at fault, then you are the cause of your own injuries. You cannot claim compensation for causing your own injuries. The funny example I give is that if the opposite were true, people would be slamming their cars into trees and lamp posts and claiming compensation. </span></b></div>

<b><span style="font-size: large;">2) If there is a split in fault, for example 50/50 or 75/25 (allocation of responsibility), then it follows that your compensation would be reduced by the percentage of fault attributable to you. For example, if a judge were to decide your injuries and damages were assessed at $100,000, but you were 50% at fault for the collision, then your final award would be $50,000. </span></b></div>

In a nut shell, if you have valid coverage and are considered to be at fault for the collision, then you may be entitled to certain basic benefits for disability, rehabilitation, homemaker and death benefits in the event of death. </span></b></div>

<b><span style="font-size: large;">No fault benefits are available, regardless of fault, if you are determined to be eligible for those benefits. In a very basic situation, if you caused an accident and have some injuries requiring physiotherapy, chiropractic care, or massage - then some nominal coverage may be available to you. If there are complex injuries, requiring home care and/or disability benefits, there may also be some coverage available. This "coverage" is not compensation for injuries, it is akin to some basic health benefits. </span></b></div>

She hired a lawyer and brought a civil suit against ICBC for, among other things, malicious prosecution. ICBC was punished for their conduct and ordered to pay the plaintiff $350,000 in punitive damages. Punitive damages are damages exceeding simple compensation and awarded to punish the defendant.</span></div>

<span style="font-size: large;">In January 2000, the couple left an English language class in Burnaby when they were involved in an accident at the intersection of Nelson and Imperial. The couple was in a crosswalk when Arsenovski’s husband was struck by a motor vehicle. Arsenovski herself also fell as a result and was injured. </span><span style="font-size: large;">A week later, the couple was encouraged by a friend to report the accident to ICBC. Their friend acted as a translator, as the couple spoke very little English.</span></div>

<span style="font-size: large;"><br /></span></div>
<div style="text-align: justify;">
<span style="font-size: large;">The judge summarized that “Mrs. Arsenovski’s only understanding of the purpose of going to ICBC was that maybe it might pay the medical bills, including the ambulance bill. She was not told that they could make a claim for damages and that this was the reason for meeting with ICBC...” . </span></div>

<div style="text-align: justify;">
<span style="font-size: large;">“She said there was not a similar system for making a report about an accident in the former Yugoslavia. ... She did not understand anything about the process at ICBC or think the statement was important in every detail.”</span></div>

<span style="font-size: large;"><br /></span></div>
<div style="text-align: justify;">
<span style="font-size: large;">In response, the ICBC adjuster forwarded a report to Crown Counsel, written by Gould, recommending a total of three fraud charges against the couple. Gould was an in-house special investigator at ICBC. In the report, Gould alleged that Arsenovski made claims she was hit by the car. The Crown accepted one of the recommendations and charged Arsenovski with making a false statement contrary to the <i>Insurance (Motor Vehicle) Act</i>.</span></div>

<div style="text-align: justify;">
<span style="font-size: large;">Mrs. </span><span style="font-size: large;">Arsenovski had to hire a criminal defence lawyer to defend herself from those allegations. The court summarized that she went on to have those charges stayed and was successful in defending herself against the criminal charges. </span><span style="font-size: large;">The judge has ordered ICBC and Gould to pay Arsenovski the $7,225.34 for legal fees she paid to defend herself in the criminal action.</span></div>

<span style="font-size: large;">During testimony in the civil case, Arsenovski said she was so shamed by the false charge that she did not tell her friends, relatives or adult children what had happened. The charge was stayed on the first day of the criminal trial when a lawyer cited weaknesses in the evidence.</span></div>

<span style="font-size: large;">In the decision, Justice Griffin found that “Mr. Gould’s handling of the file reveals that rather than operate from a presumption of innocence, Mr. Gould operated from a presumption of guilt in respect of Mrs. Arsenovski".</span></div>

<span style="font-size: large;">“Here, the alleged making of a false statement to ICBC was an invention by Mr. Gould. The false statement Mrs. Arsenovski was alleged to have made regarding how she fell was never made by her to ICBC. There was no such statement and so it could not have been false...” </span></div>

<span style="font-size: large;">The court notes that Gould’s report was written in such a way to dissuade the Arsenovskis from filing a civil claim for compensation for injuries: </span><span style="font-size: large;">“Mr. Gould focused on the Arsenovskis’ potential civil claims, which they had not yet filed. He focused on the Arsenovskis being ‘recent immigrants’ who had just applied for ‘refugee status’ and the fact that they were on ‘social assistance.’ ”</span></div>

Griffin of the BC Supreme Court held that a medical witness testifying on behalf of ICBC crossed the line into prohibited advocacy - a legal concept used in the court system to ensure that all expert witnesses come to court to provide independent and impartial evidence.</span><br />

<i>[63]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>The defendant called the evidence of Dr. Duncan McPherson, an orthopaedic surgeon, who performed a medical examination of the plaintiff at the request of the defendant.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[64]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Dr. McPherson was a very unhelpful medical witness.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[65]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Dr. McPherson has not practised medicine for years. He stopped his work as a surgeon in 1992 or 1994 and ceased practising medicine in 1997. It is difficult to assume that he is up to date on medical studies regarding soft tissue injuries and pain.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[66]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Dr. McPherson is wholly reliant on the Insurance Corporation of British Columbia (“ICBC”) for his income and has been for years. He was clever, and I mean this not in a complimentary way, when questioned about his reliance on ICBC for his income in the last several years, hinting at the notion that he had other sources of income. He then agreed the other sources of income were simply his investment income.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[67]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Dr. McPherson’s approach to examining patients appeared to be dependent on a verbal test. He asks the patient to explain the patient’s complaint, and if the patient does not mention pain in his answer, he concludes that in his opinion the patient does not have pain and thus does not have a lasting injury. Dr. McPherson stated that when patients describe complaints in the activities they can do, rather than stating they have pain in a body part, that is because they are not sure where the pain “should” be, implying that the patient is not telling the truth if they do say they have pain.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[68]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Dr. McPherson was in my view overly confident that the question he poses to patients is a scientifically valid “truth-o-meter”, foolproof in discovering whether pain exists or not. He seemed completely close-minded to the possibility that some patients might not understand what he means by “complaint” or may not consider “pain” to be a complaint but a condition that they simply deal with on a day-to-day basis.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[69]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Dr. McPherson found it highly relevant that when he asked the plaintiff about his present complaints relating to the accident, the plaintiff did not say he has pain, but said he is limited to certain activities now, such as he cannot do heavy work, or has issues with his back hurting during sexual activities. Dr. McPherson appeared to conclude that because the plaintiff did not say “I have pain in my back” during the interview, he therefore did not have a chronic pain injury in his back.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[70]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>I found Dr. McPherson’s logic to be at best simplistic and superficial. At worst it reveals that Dr. McPherson holds such a degree of cynicism regarding patients advancing claims against ICBC that he is not independent and his evidence is unreliable.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[71]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>When it was suggested to Dr. McPherson he may not have written down exactly what the patient said he was absolutely confident that he was always a perfect recorder of what patients said to him. This is so despite the brevity of his report. A reasonable, educated person would allow for the possibility of mistakes being made in transcribing a patient’s comments, but Dr. McPherson did not do so, illustrating his close-minded disposition.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[72]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>It seems obvious to me that when describing his limitations to Dr. McPherson, the plaintiff was intending to convey to Dr. McPherson that the accident caused these limitations because of the pain he suffers, as he explained in court. The fact that he might not have spelled out to Dr. McPherson in a more explanatory way that ”the accident caused me to have pain in my back which limits me from these activities” is not an admission that proves that his injuries do not cause him pain in his back.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[73]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Also, Dr. McPherson gave significant weight to the fact that the plaintiff exhibits a full range of motion. He seemed unwilling to accept that a person can have a full range of motion but also suffer from pain. Dr. Lepard, the plaintiff’s family doctor until she retired in 2011, said that it is not uncommon for a patient with an injury to have full range of motion but also to have pain. I prefer Dr. Lepard’s evidence on this point, as it is consistent with the plaintiff’s evidence that he has pain on prolonged activity on a recurring basis.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[74]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Dr. Lepard did agree that the plaintiff’s range of motion suggested that his whiplash injury was not as serious as Category 3 and 4, but was more in the Category 2 range, of being in the medium to low end of whiplash soft tissue injuries.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[75]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>Dr. McPherson concluded that there was no “objective” evidence of a disability relating to the motor vehicle accident. This is not a helpful opinion in relation to the injuries in this case. Pain may not something that can be measured objectively with a scientific instrument, but it can still be disabling.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[76]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>I note that even the defendant concedes on the whole of the evidence that the plaintiff has suffered a soft tissue injury which will cause some future loss of earning capacity.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[77]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>I do not find Dr. McPherson’s evidence to be of any value in deciding the issues in this case.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[78]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>I prefer the evidence of Dr. le Nobel and Mr. Kyi, as supported by the evidence of the plaintiff himself, regarding the fact that the plaintiff has continued to suffer from back pain since the accident, which gets worse on some activities, and which has not resolved and is likely to continue in the future, limiting him in some of his activities.</i></div>
<div class="SCJNumber" style="font-family: Arial, sans-serif; line-height: 24px; margin: 0in 0in 12pt; text-indent: 0in;">
<i>[79]<span style="font-family: 'Times New Roman'; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>The whole of the evidence persuades me that the accident caused injuries to the plaintiff that continue to this day and are likely to be chronic and to continue into the future. These injuries cause him back pain that becomes intolerable with prolonged standing, sitting, bending, or heavy lifting.</i></div>

She was working as a co-op student in what was to be a 12 month position, which commenced in September 2010.</span></i><br />

Ms. Valino was the front seat passenger in an SUV driven by the defendant, Bok Wing Haley Chu, travelling northbound on Highway 40 near Grand Cache, Alberta. Mr. Chu admits he lost control of his vehicle at a curve in the road. The vehicle left the highway and rolled a number of times before coming to rest on its wheels. The front airbags deployed and the SUV was a total loss.</i></div>

<span style="font-size: large;">In awarding $500,000 for the loss of future income earning capacity, he states:</span></div>

<i>[155]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>I think it is reasonable to assess Ms. Valino’s future loss of income earning capacity on the basis that there is a 50% chance she will be unable to work in the more lucrative positions available for mining engineers in the more remote areas, and unable to obtain the skills necessary to move into mine management. The tables provided show the lump sum present value of an average lifetime salary of $175,000 is $3,230,850, based on a multiplier of 18.46, or $4,147,850, based on a multiplier of 23.70. The present day value of the average salary for a Canadian female engineer of $117,562, using a multiplier of 18.462, is $2,170,429. The difference between the two if the same multiplier is used is approximately $1.1 million. On these calculations Ms. Valino’s loss would be approximately $550,000, which is similar to the amount of loss calculated if she lost her remote living allowances.</i></div>

<i>[156]<span style="font-family: "times new roman"; font-size: 7pt; font-stretch: normal; line-height: normal;"> </span>The defendants assert that the appropriate award, if Ms. Valino establishes that she has suffered a loss of future earning capacity, is that set out in Dobre of $60,000, on the basis that her only diminishment in income earning capacity is due to her finger injury. However, as discussed earlier, Dobre is distinguishable on its facts. In this case, not only does Ms. Valino have diminished capacity due to her hand injury but also due to her back and neck injuries which preclude her from prolonged sitting at a desk or computer.</i></div>
